Terms of Service

These Terms of Service govern access to and use of Ofértamelo, operated by Ofertamelo MB, Vaivorykstes g. 18, 02166 Vilnius, Lithuania (“Ofértamelo”, “we”). By creating an account or using the service you agree to them. If you use Ofértamelo on behalf of a company, you confirm you are authorised to bind it.
What Ofértamelo is
Ofértamelo provides software tools for service professionals: an embeddable quote widget, a configurable pricing engine, quote delivery by email (and, where available, WhatsApp or SMS), lead management, visit scheduling and a dashboard. The estimates it produces are generated from the prices, rules and wording you configure and are made by you, in your name, to your customers. Ofértamelo is a tool provider — never a party to, guarantor of, or broker for any contract between you and your customers.
Estimates are yours
You are solely responsible for the rates, rules, taxes, disclaimers and wording you configure, and for honouring, revising or withdrawing the estimates your widget produces. Estimate ranges are labelled as approximate and subject to an on-site visit; whether and how you stand behind them is your commercial decision. Where artificial intelligence assists the service — interpreting a customer's description or photos, drafting presentation wording — it never sets prices: every amount is computed deterministically from your configuration. Review AI-assisted content before relying on it.
Eligibility and your account
The service is offered to businesses and professionals, not consumers, and you must be of legal age to contract. Keep your credentials confidential; activity under your account is attributed to you. You must hold the rights to the business name, logo, phone number and content you configure. One account serves one business.
Fees and billing
Plans are billed monthly in advance through our payment provider (Stripe), at the prices shown on the pricing page, exclusive of VAT and in the billing currency determined by your business country. A verified lead — a visitor who completed an estimate and confirmed their contact details — is the metered unit; verified leads above your plan's monthly allowance are billed at the per-lead overage rate shown for your plan. Plan changes take effect immediately: on an upgrade, the prorated difference for the rest of the billing period is charged at once; on a downgrade, the unused value is applied as credit against your future invoices (credit is not refunded to your payment method). You may cancel at any time; cancellation stops renewal at the end of the paid period. Except where required by law, fees are non-refundable. We may change prices with at least 30 days' notice to your account email; changes apply from your next renewal.
Your data and your customers' data
How personal data is handled is described in the Privacy Policy, which forms part of these Terms. For quote requests submitted through your widget, you are the data controller and Ofértamelo processes the data on your behalf. You warrant that you have the right to collect the data your intake form requests. You can export all your data and delete your account — including all leads, photos and files — from Settings at any time.
Acceptable use
You must not use Ofértamelo to send unsolicited messages, to collect data you have no legal basis to collect, to misrepresent who is making an offer, to probe or disrupt the service, or for anything unlawful. Messaging channels follow the policies of their operators (including Meta's business-messaging policies for WhatsApp); abuse may lead to suspension of a channel or, for serious or repeated violations, of the account. We may suspend accounts that present a security or legal risk, with notice where practicable.
Third-party services
Parts of the service interoperate with third parties — for example Stripe for payments, or Google Calendar if you choose to connect it. Their availability is subject to their own terms, and features that depend on them may change if those services change. Optional connections such as Google Calendar are activated only by your explicit action and can be disconnected at any time in Settings.
Intellectual property
Ofértamelo and its software, design and branding remain our property. You retain all rights to the content and configuration you create; you grant us the licence needed to host, process, display and deliver it, solely to operate the service for you. Feedback you send us may be used to improve the service without obligation.
Availability and changes to the service
We work to keep the service available, fast and accurate, but it is provided “as is” and “as available”, without warranties of uninterrupted or error-free operation. We may improve, modify or discontinue features; if a change materially reduces the service you pay for, we will notify your account email in advance.
Liability
Nothing in these Terms excludes liability that cannot be excluded by law, including for wilful misconduct or gross negligence. Subject to that, our total aggregate liability for all claims related to the service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim, and we are not liable for indirect or consequential losses, lost profits, or the outcome of jobs, offers, negotiations or contracts between you and your customers.
Termination
You may close your account at any time from Settings; closure erases your data as described in the Privacy Policy — export first, erasure is irreversible. We may terminate for material breach that remains uncured 14 days after notice, or immediately for serious abuse or legal necessity. Sections that by nature survive (fees due, liability, intellectual property) survive termination.
Changes to these Terms
We may update these Terms; material changes will be announced to your account email at least 15 days before they take effect. Continued use after the effective date constitutes acceptance.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Lithuania. Disputes are submitted to the courts of Vilnius, Lithuania, without prejudice to any mandatory venue provided by law.
